Eminent Domain: Justified Takings or Governmental Land Grab?

Abstract:

This paper takes an in-depth look at changes in the way federal, state, and local governments use eminent domain to acquire property over the past decade. It looks at the traditional uses of governmental property takings and the role that recent Supreme Court decisions have had on the way government uses eminent domain.

The paper questions whether it is constitutionally legal for government to use eminent domain as a means of sparking economic development and if it is for the greater "public good" that government takes property from one private landowner and gives it to another private citizen or company for redevelopment. Property rights are a cornerstone of American freedom; the erosion of these rights are starting to have a profound effect on the liberties that all Americans take for granted.
